Our client, a leading wealth management firm, provides personalized investment solutions for private clients, specializing in estate planning, Medicaid planning, and wealth preservation. We seek an experienced In-House Attorney to support the firm’s mission of delivering exceptional legal and financial guidance.
The In-House Attorney will provide legal expertise in estate planning, Medicaid planning, and regulatory compliance, collaborating with financial advisors, clients, and external counsel to ensure client investment accounts comply with applicable laws. The ideal candidate has a strong background in estate planning, Medicaid eligibility, and trust administration, with excellent communication and problem-solving skills.
Responsibilities:
- Draft, review, and advise on estate planning documents, including wills, trusts, powers of attorney, and advance directives, to align with clients’ wealth management goals.
- Provide legal guidance on Medicaid eligibility and asset protection strategies, ensuring compliance with federal and state regulations.
- Assist in the creation, management, and administration of trusts, including revocable and irrevocable trusts, special needs trusts, and charitable trusts.
- Ensure compliance with securities laws, fiduciary standards, and other relevant regulations governing wealth management and investment accounts.
- Collaborate with financial advisors to provide legal advice to clients on complex estate and Medicaid planning matters.
- Draft and review contracts, agreements, and disclosures related to client accounts and vendor relationships.
- Identify and mitigate legal risks associated with wealth management services and client transactions.
- Develop and implement internal policies and procedures to ensure adherence to legal and regulatory requirements.
- Coordinate with outside counsel on specialized legal matters, litigation, or complex regulatory issues when necessary.
Qualifications:
- Active license to practice law in New York.
- Legal experience in Estate and Medicaid planning, wealth management, trust administration, and elder law.
- Prior in-house experience in a financial services or wealth management firm is a plus.
- Deep knowledge of estate planning, trust law, and Medicaid regulations.
- Familiarity with securities laws and fiduciary responsibilities in wealth management.
- Strong analytical and problem-solving skills with attention to detail.
- Excellent written and verbal communication skills for drafting legal documents and client interactions.
- Ability to work collaboratively with cross-functional teams and high-net-worth clients.
- Proficiency in legal research tools (e.g., Westlaw, LexisNexis).
