Prevail Recruiting is partnering with a long-established, highly successful boutique personal injury law firm in Newport Beach to identify an experienced Pre-Litigation Personal Injury Attorney.


This is intentionally not the large, national, high-volume PI model where attorneys can feel like another name on a roster.


Our client has built its business differently.


They've developed a highly successful practice around reputation, results, personal client relationships and exceptional service. The firm has remained intentionally smaller and more entrepreneurial, giving its attorneys the opportunity to make a meaningful individual impact while having the infrastructure and resources of an established personal injury practice.


And when attorneys produce exceptional results, they participate financially in that success.

This opportunity offers a $165,000–$225,000 base salary plus substantial performance-based compensation. Successful attorneys can earn several multiples of their base compensation, with top producers earning $800,000+ annually.

The Opportunity

You'll take ownership of plaintiff-side personal injury matters throughout the pre-litigation lifecycle, developing cases from initial evaluation through demand, negotiation and settlement.

You'll work closely with clients and the firm's support team while maintaining responsibility for case strategy, progression and ultimately maximizing the value of each matter.


Responsibilities will include:

  • Managing a portfolio of plaintiff-side personal injury cases from intake through settlement
  • Evaluating liability, damages, insurance coverage and potential case value
  • Developing strategy for each case
  • Monitoring medical treatment and case progression
  • Maintaining consistent, high-quality communication with clients
  • Reviewing medical records, reports, bills and supporting evidence
  • Identifying coverage issues and available policy limits
  • Preparing and reviewing settlement demands
  • Negotiating directly with insurance adjusters and carriers
  • Evaluating settlement offers and advising clients
  • Maximizing case value while moving matters efficiently toward resolution
  • Identifying cases that should transition into litigation
  • Working closely with case managers, legal support staff and litigation attorneys

Who We're Looking For

We're looking for an experienced attorney who already understands plaintiff-side personal injury and pre-litigation case management.


The strongest candidates will bring:

  • Active membership in good standing with the California State Bar
  • Meaningful plaintiff-side personal injury experience
  • Hands-on pre-litigation experience from intake through settlement
  • Strong settlement negotiation experience
  • Experience evaluating liability, damages, treatment and case value
  • Ability to effectively manage a meaningful caseload
  • Excellent client communication skills
  • Strong organizational and case-management ability
  • Confidence negotiating directly with insurance carriers
  • A competitive, results-oriented mentality
  • High personal standards and an appreciation for reputation and client service


Experience involving automobile accidents, commercial vehicle accidents, premises liability, catastrophic injuries, wrongful death and other negligence matters is highly relevant.


Compensation & Benefits

This is one of the more compelling aspects of the opportunity.

Base Salary: $165,000–$225,000

Performance Compensation: Significant additional earnings tied to individual results

Top Producer Earnings: $800,000+ annually
